I, Brian Robran, do declare and say:

I make this Declaration in, support of Defendant and Counterclaimant
Capella University’s (“Capella”) Supplemental Opposition to Motion to Strike
Counterclaim. I am make these statements based on my own personal knowledge and
if called as a witness, would and could testify competently thereto.
I work in the area of Business Analytics and serve as the Measurement Manager at Capella.
I attended the University of Minnesota and earned a BS in Agricultural Business, and a MBA in Finance. After my tenure at the University of Minnesota, I spent two years in the corporate finance area at US Bank, followed by five years with Target Corporation, where I served as a Financial Analyst for the Target Financial Service Division. I came to Capella on March 1, 2004, I originally held the position of Data Analyst, and was promoted to my current position in June 2005.
As part of our normal business practices, Capella tracks the reasons stated by potential learners who choose not to come to Capella. This assists us in evaluating our recruiting message and alerts us to issues which may affect a potential learner in reaching a decision as to whether he or she wishes to attend Capella.
Since July 2005, ten potential learners have specifically stated that their reason for not enrolling at Capella is the negative website, capellasucks.com, and other sites which plaintiff, , has confirmed he has designed. Attached to the Declaration as Exhibit A is a true and correct copy of the listing from our business records indicating the individuals that have cited these websites as the reason for not enrolling in Capella.

Did Brian Robran Lie to the Court?

If so, he certainly won't be the first from Capella University to do so!

As noted above, Robran refers to "the negative website, capellasucks.com" as being responsible for causing prospective students from being scammed by Capella University. The only problem is, the domain he refers to is owned by Capella University!

That's right, Capella University owns the domain:

Perhaps he knows something that Capella wants to blame on others! It's a good thing that Brian Robran works in the area of Business Analytics - his astute observation skills would seem to indicate that he received his MBA from his employer. (Or is he just an "independent contractor?")

Lets not forget to mention Capella's "enrollment problem" - since the first site was established (July 2004) to report on the the sleazy practices at Capella University, Capella's enrollment has SOARED an incredible 45% - that's right, their enrollment climbed from 10,000 students to 14,500 in just one and a half years! Of course, Brian Robran forgot to "analyze" that fact. Oh, let's not forget to mention that Capella's Dream Team, Sir Chrisy the Sissy L'Orange and Capella Stella Fey Epling, also kept that little FACT from the court. Capella didn't announce the tremendous growth they had recently experienced, during the same period that Robran and others were whining about how badly Capella has been hurt (boohoo!)! During that period (October 2005 to January 2006) Capella's growth soared from "nearly 13,000" students to 14,500 students! Gosh, we can't help wonder why these slimy cowards chose to hide that fact from court!
